CHENNAI : A legal challenge has been filed before the Madras High Court seeking to halt upcoming by-elections in the Madurantakam and Dharapuram Assembly constituencies. The petition, brought forward by advocate K. Suthan, calls for the Election Commission of India (ECI) to implement stricter accountability measures for elected representatives who step down from their positions before their terms conclude.
The petitioner argues that the frequent resignation of MLAs necessitates costly by-elections, placing an undue financial burden on the public exchequer. The plea specifically requests that the court intervene to prevent the ECI from proceeding with the polls in these two constituencies until a framework for financial responsibility is established.
Proposed Financial and Legislative Reforms:
At the heart of the petition is the concept of an “Election Expenditure Security” deposit. The lawyer has urged the court to direct the ECI to mandate that former MLAs Maragatham Kumaravel and P. Sathyabama—who resigned from their respective seats in Madurantakam and Dharapuram shortly after being elected—provide this security as a prerequisite for filing nomination papers in any future by-election.
Beyond the immediate financial recovery of election costs, the petition advocates for broader legislative changes. The petitioner has requested that the court direct the ECI to explore statutory disqualification or a mandatory “cooling-off” period. Such a measure would aim to prevent representatives who resign voluntarily and without compelling circumstances from contesting subsequent elections for a specified duration.
Scope of the Legal Challenge:
The petition extends its focus beyond the two specific constituencies of Madurantakam and Dharapuram. It also requests that the Madras High Court direct the ECI to submit a comprehensive report detailing the estimated expenditures associated with conducting by-elections across several other regions, including Trichy East, Karur, Viralimalai, Perundurai, and Ambasamudram. These polls were also triggered by the resignations of the sitting MLAs.
The matter is scheduled to be heard by the first bench of the Madras High Court, presided over by Chief Justice Sushrut Arvind Dharmadhikari, on Wednesday. The court’s decision on whether to grant an interim stay on the by-elections or to direct the ECI to formulate new regulatory guidelines remains the central point of interest in this ongoing legal development.
